 Welcome to mhahouston.org, a website of Mental Health America of Greater Houston, a Texas nonprofit corporation (“we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website https://www.mhahouston.org (the “Site”), including all features, functionality, and services offered through it, including our Care Connect provider search tool (collectively, the “Services”).

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

  1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the provider search tool. By using our Services, you confirm that you meet these requirements.

  1. Our Services

Our Services help users find and connect with behavioral health providers (Behavioral health encompasses both mental health and substance use care.). While using the Services, you may encounter content from us or our affiliates, including text, data, images, videos, articles, and professional profiles. We strive for accuracy but make no guarantees about the reliability, completeness, or accuracy of this content, including details like qualifications, service quality, or insurance. You assume full responsibility for any decisions made based on the content, and we are not liable for any resulting actions. We also do not endorse or recommend any individuals or organizations featured in the content.

We are not a healthcare provider, and we do not provide medical or behavioral health treatment ourselves. Using the Services—including contact features (such as email or phone), the provider directory, external links, or any support we offer to help you find a provider—does not create a “provider-patient relationship” with either the provider or Mental Health America of Greater Houston.

All providers listed on our Site operate independently and are solely responsible for the services they provide.

  1. No Medical Advice

The content and tools provided through the Site are for informational and connection purposes only. We do not offer medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider regarding a medical or behavioral health condition.

  1. Site Access and Provider Information

Users and providers may voluntarily submit personal information through the Site, authorizing Mental Health America of Greater Houston to use it as described in the Privacy Policy. This may include identifiable information shared via email.

Users can browse the Site without sharing personal data, but to contact a provider, you may need to submit your name, email, and phone number, which will be shared with that provider. You must agree to these Terms before doing so. Note: Messages sent via the Site’s contact form are transmitted through email, which may not be fully secure.

Providers agree to work with Mental Health America of Greater Houston to create a public profile, including their name, professional background, and services.

Mental Health America of Greater Houston does not guarantee a provider’s availability and is not responsible for missed appointments or any resulting harm. Users are responsible for verifying a provider’s qualifications before engaging their services and assume all risks in doing so.

Mental Health America of Greater Houston reserves the right to remove profiles, terminate accounts, or restrict access to the Site or Services at its sole discretion, without prior notice.

  1. User Accounts

To access certain features, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use of your account

You agree not to impersonate anyone or use false, incomplete or misleading information.

  1. Privacy and Data Protection

Your use of the Site is also governed by our Privacy Policy which explains how we collect, use, and protect your personal information, including Personal Health Information, in accordance with applicable laws (including HIPAA, where applicable).

  1. User Conduct

You agree not to use the Site to:

  • Violate any law or regulation
  • Harass, abuse, or harm another person
  • Impersonate any person or misrepresent your identity
  • Interfere with our normal operation or security
  • Upload or transmit harmful code or content

We reserve the right to suspend or terminate your access for any violation of these Terms.

  1. Fees and Payments

Mental Health America of Greater Houston does not charge users any fees for using its Site to connect with providers. Any payment arrangements for services provided by individual providers are made directly between the user and the provider. Mental Health America of Greater Houston does not receive any portion of these payments.

  1. Provider Relationships

We do not employ, supervise, or control the providers. Any relationship you establish with a provider is solely between you and that provider.

We are not responsible for the quality, safety, or legality of the services provided by any provider. Any concerns or disputes must be resolved directly with the provider.

  1. Disclaimers and Limitation of Liability

We provide the Site “as is” and “as available.” We make no warranties, express or implied, regarding the accuracy, reliability, or availability of our Services.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages resulting from your use of or inability to use the Site, including damages resulting from the actions or omissions of providers.

  1. Indemnification and Waiver

You agree to indemnify and hold harmless Mental Health America of Greater Houston, its officers, employees, agents, and affiliates, from any claims, damages, or expenses (including legal fees), and specifically and intentionally waive any right or claim in law or equity you may have against any of them, arising from your use of the Site, your violation of these Terms, or your interaction with any provider.

  1. Modifications to the Terms

We may update these Terms from time to time to conform to new laws and regulations or changes in business standards. Continued use of the Services after changes means you accept the updated Terms.

  1. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. You may also stop using the Site at any time.

  1. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. You agree to resolve any disputes through binding arbitration or in the courts located in Harris County, Texas.
